McDonald’s Corp. won’t face rehearing on whether it exercised enough control over a Bay Area franchisee’s workforce to be liable for a franchiser’s alleged violations of California wage law, the Ninth Circuit ruled Dec. 11.
The U.S. Court of Appeals for the Ninth Circuit also declined the franchisee workers’ request to send questions of state law to the California Supreme Court. State labor regulators had urged the Ninth Circuit to grant the request, saying that the state high court should get a chance to “offer definitive answers” to legal issues that a federal appeals court decided.
