There is no private right of action to enforce a New York law limiting the amount health-care providers and their representatives can charge for copies of medical records, the state’s top court said.
People alleging they’ve paid too much to acquire records from providers or data storage firms like Ciox Health LLC can’t sue to recoup the overcharge, the New York Court of Appeals said.
New York’s public health law requires health-care providers to give patients and their representatives copies of medical records. The law allows providers to charge a “reasonable amount,” not to exceed 75 cents per page.
