New Yorker Kicked Out of Med School Gets New Shot at Bias Claims

A New York man who alleges he was kicked out of medical school because of his mental health, and his sexual orientation, will get another chance to prove his claims.

The U.S. Court of Appeals for the Second Circuit July 18 reinstated John Purcell’s claims against the New York Institute of Technology-College of Osteopathic Medicine. A federal district court incorrectly concluded a state education law’s four-month statute of limitations barred Purcell’s action, the appeals court said.

Purcell alleges several NYIT staff members made derogatory remarks about his mental health and sexual orientation during reinstatement proceedings after he had been suspended. ...
