A radiologist and his employer were entitled to judgment in a suit alleging he negligently failed to detect a patient’s breast cancer, as he fulfilled the duties he owed to the patient when he screened her mammogram, a New York appeals court said.
Kenneth Blumberg and Hudson Valley Radiology Associates PLLC established that Blumberg acted in accordance with prevailing standards of care, the New York Supreme Court, Appellate Division, Second Department, said. Blumberg’s interpretation of Lynell Green’s mammogram conformed with accepted practices, it said.
