New York Podiatry Practice Beats Whistleblower’s Fraud Claims

A Batavia, N.Y.-based podiatry practice beat False Claims Act allegations that it sought payments from Medicare and Medicaid despite noncompliance with medication safety standards, a New York federal court said.

George R. Vito, a podiatrist who formerly worked at Advanced Podiatry Associates, didn’t identify any particular false claims that were submitted to the government, and didn’t allege facts suggesting that alleged schemes resulted in the submission of false claims, Judge Lawrence J. Vilardo of the U.S. District Court for the Western District of New York said in a Tuesday opinion.
