Montefiore Medical Center’s six-month delay in terminating a physician for her arrest raised questions about whether it really fired her because she asked for an accommodation for a disability, a federal court in New York said.
A jury must decide if the hospital terminated Rachel Wellner’s employment based on her disability or if it had a legitimate reason for doing so, the U.S. District Court for the Southern District of New York said Aug. 29. The court denied Montefiore’s request for pretrial judgment.
