Doctors suing a New Jersey hospital for terminating their privileges when they also began working for another institution saw their $24 million jury verdict tossed, with a new trial ordered by the state’s high court due to the use of improper evidence.
Hospitals fending off competition could be on the hook for millions of dollars in damages if they kick out doctors who start working at other hospitals, the New Jersey Supreme Court ruled. However, the court said doctors can’t look to hospital bylaws to get breach-of-contract damages.
