A New Jersey neurologist’s medical malpractice insurance policy didn’t cover nearly $3 million in damages owed to a patient with whom he had a sexual relationship.

Physician Jonathan Fellus wasn’t acting within the scope of his employment when he had an affair with Lorette Schroth, so neither his employer nor the insurer had a duty to defend or pay damages to Schroth under the policy’s terms, the U.S. District Court for the District of New Jersey said June 5.
