A New Hampshire woman can proceed to trial on whether her medical providers caused her further injuries by negligently caring for her following knee surgery, the state’s top court said.
The patient produced sufficient expert opinion evidence at this stage to establish the standard of care, a breach of that standard, and that the the breach caused her injuries, the New Hampshire Supreme Court said Tuesday. The court reversed summary judgment for the providers and sent the case back to the trial court for further proceedings.
