A Nevada court has nixed a lawsuit alleging health-care providers committed battery by exceeding the scope of a patient’s informed consent to a medical procedure (Humboldt Gen. Hosp. v. Sixth Judicial Dist. Ct., 2016 BL 243943, Nev., No. 65562, 7/28/16).
The Nevada Supreme Court July 28 said a trial court should have dismissed plaintiff Kelli Barrett’s complaint against Humboldt General Hospital and Dr. Sharon McIntyre because Barrett failed to comply with a state requirement that an expert affidavit accompany a medical malpractice filing.
