A Nevada anesthesiologist can proceed with a lawsuit contesting a surgical center’s suspension of his clinical privileges for allegedly refusing to allow staff to check his temperature during the Covid-19 pandemic.
A lower court incorrectly granted pretrial judgment for Specialty Surgicare of Las Vegas LP based on the Health Care Quality Improvement Act because that law doesn’t immunize providers against claims for declaratory relief, the unanimous Nevada Supreme Court said Nov. 21. The ruling also deprived Rajeev Khamamkar of the ability to discover facts necessary to rebut the outpatient center’s immunity claim, it said.
