A Nebraska nursing home lost its bid to sue federal officials to force them to keep up its Medicare payments while it contests a noncompliance ruling because it must complete an administrative review process first, a federal court said.
Oakwood Ventures LLC must comply with the Medicare Act’s requirement that issues arising under the law must be fully exhausted under the U.S. Health and Human Services Department’s administrative review process before being taken to court, the U.S. District Court for the District of Nebraska said.
