N.Y. Podiatric Negligence Plaintiff Loses Bronx County Venue

A New York woman suing her podiatrist must do so in Westchester County, not her preferred Bronx County court, because it’s where the doctor’s principal place of business is located, the state’s top court said.

Racquel Lividini argued her medical malpractice case should be heard in the Bronx because Harold Goldstein provided a Bronx mailing address to New York’s professional licensing board.

But New York’s licensing law doesn’t require a physician to identify a particular county as the location of his principal office, the New York Court of Appeals said.
