Mylan, Teva, Others to Face Narrowed Antitrust Case by State AGs

Mylan NV, Teva Pharmaceutical Industries Ltd., and other top generic-drug manufacturers lost their bid to dodge antitrust claims brought by nearly every state attorney general, but a federal judge in Philadelphia pared back the case, saying the states can’t seek disgorgement of profits.

Judge Cynthia M. Rufe let the state AGs move forward Tuesday with their quest for an injunction, finding that their interest in “securing an honest marketplace” fits “neatly” within the legal framework giving states standing to sue over harm to their citizens.
