Mylan, Teva Lose Bid to Scale Back Generic Drug Antitrust Case

Mylan NV, Teva Pharmaceutical Industries Inc., and other generic drug manufacturers lost their bid to chip away at multidistrict litigation over an alleged industrywide price-fixing cartel, when a federal judge in Philadelphia declined to narrow the scope of three related cases.

Judge Cynthia M. Rufe let consumer protection and unjust enrichment claims move forward Tuesday in the US District Court for the Eastern District of Pennsylvania, rejecting a series of attacks by the drugmakers based on technical or state-specific grounds.
