Mylan, CVS, Express Scripts, Optum Trim EpiPen Price-Gouge Case

Mylan NV, CVS Health Corp., Cigna Corp., and UnitedHealth Group Inc. affiliates chipped away Tuesday at price-gouging litigation over the EpiPen, a lifesaving allergy treatment, when a federal judge in Minneapolis narrowed the proposed class action.

Judge Eric C. Tostrud tossed or trimmed many of the racketeering and antitrust claims brought by wholesalers in the U.S. District Court for the District of Minnesota over the alleged scheme to inflate the EpiPen’s price through bribes and kickbacks aimed at marginalizing a competing device.
