Montana Vaccine Discrimination Law Challenge Denied Second Look

A Montana law that bars health-care providers from denying goods, services, or employment based on a person’s vaccination status will remain in effect after a full federal appeals court declined to consider if it should be struck down.

The full US Court of Appeals for the Ninth Circuit won’t rehear arguments over whether the federal Americans with Disabilities Act and the Occupational Safety and Health Act facially preempt the state law, the court said Tuesday. It didn’t give a reason for the denial.
