Montana’s health department must face trial in a suit alleging that it unconstitutionally deprived a medical marijuana dispensary and its owner of their license without a prior hearing, a federal trial court said.
Disputes over several material facts precluded summary judgment for Organic Medical Supply and Steven Palmer on whether the Montana Department of Health and Human Services violated their due process rights, the US District Court for the District of Montana said Wednesday.
