A Montana hospital won’t face trial over terminating a cancer doctor’s ability to see patients there and effectively ending his employment.
The Health Care Quality Improvement Act shielded St. Peter’s Health from liability in Thomas Weiner’s suit over its revocation of his medical staff membership and clinical privileges, the Montana Supreme Court said Tuesday.
The hospital took objectively reasonable actions leading up to and including the revocation based on other doctors’ concerns about the oncologist’s patient care and independent reviews of his cases, Justice Laurie McKinnon said in a unanimous opinion.
