Moderna Dodges Washington Woman’s Covid-19 Vaccine Injury Suit

The federal Public Readiness and Emergency Preparedness Act shields vaccine maker Moderna US Inc. from suit and liability for injuries allegedly caused by its Covid-19 vaccine, a federal court in Washington said.

Moderna is a “covered entity” within the meaning of the PREP Act and the vaccine qualifies as a “covered countermeasure,” meaning the drugmaker can’t be sued for damages allegedly arising out of its administration, the US District Court for the Western District of Washington said Sept. 20 in dismissing the case.
