The validity of Missouri laws that restrict abortions performed after eight weeks gestation or solely because of a fetal diagnosis of Down syndrome will get a new appellate hearing, the Eighth Circuit said Tuesday.
The U.S. Court of Appeals for the Eighth Circuit—on its own motion—granted en banc review of an appeal from a trial court decision barring the state from enforcing the laws. No party to the case requested full court review.
A three-judge panel affirmed that decision June 9, saying the laws banned, rather than regulated, previability abortions and thus were unconstitutional under U.S. Supreme Court precedent.
