A Mississippi woman and her husband will get a new trial in a medical malpractice case against a neurosurgeon over a spinal procedure that led to her paralysis, a state appeals court said.
Surgeon Adam Lewis’ evidence wasn’t legally sufficient to prove his compliance with the standard of care while operating on Mary Margaret Upchurch to replace the battery leads to a pain management device, the Mississippi Court of Appeals said Tuesday.
