Mississippi Clinic Decries US Bid to Toss Trans Health Rule Suit

A Mississippi clinic is urging a federal judge to reject the Biden administration’s request to dismiss its lawsuit challenging federal protections for transgender health care, arguing actions in other cases shouldn’t prevent the legal challenge from moving forward.

The 2024 final rule from the US Department of Health and Human Services imposes obligations and compliance costs on McComb Children’s Clinic Ltd. that warrant the US District Court for the Southern District of Mississippi’s judgment on the regulation, the clinic said in a Tuesday filing opposing the HHS’ motion to dismiss the case.
