Michigan Targets Express Scripts, Prime With Antitrust Lawsuit

The state of Michigan is the latest to file litigation targeting a multiyear deal between two top entities that manage prescription drug benefits, alleging the companies engaged in anti competitive practices that have hurt independent pharmacies.

Express Scripts Inc. and Prime Therapeutics LLC in 2019 entered into “an unlawful agreement to fix the rates of compensation they pay pharmacies” and “conspired to eliminate competition among themselves for pharmacy business in order to extract illegal profits from the marketplace,” Michigan Attorney General Dana Nessel (D) wrote in a complaint filed Monday in the US District Court for the Eastern District of ...
