Mental Health Staffing Agencies Beat Suit Over Patient Attack

Two companies responsible for staffing an Oregon state mental-health facility won’t have to defend a civil rights suit brought by the representative of a woman who was attacked by a fellow patient, a federal court said.

Brian Rossa didn’t adequately allege Kupplin Worldwide LLC and Amergis Healthcare Staffing had official policies that posed a substantial risk of harm to Angelica Philbee or other patients at Oregon State Hospital in violation of their 14th Amendment rights, the US District Court for the District of Oregon said Wednesday.
