Medical Malpractice Case Remanded Over Expert Witness Issue

A New Jersey appeals court kicked a medical malpractice case back to the trial court over the credentials of a doctor the plaintiffs tried to use as an expert witness.

In an opinion released Thursday by the Superior Court of New Jersey Appellate Division, the panel decided that New Jersey plaintiffs in medical malpractice cases must provide expert testimony from physicians with the same board certifications as the defendant doctor if the treatment at issue involved multiple specialties.
