MedCom Carolinas Stops Whistleblower’s VA Kickback Scheme Suit

A whistleblower failed to adequately allege that MedCom Carolinas Inc. violated the False Claims Act by engaging in a kickback scheme by paying commissions to salespeople selling skin grafts to a Department of Veterans Affairs hospital, the Fourth Circuit affirmed Thursday.

Haile Kiros Nicholson’s complaint didn’t meet the high standards for pleading fraud with particularity required by the federal rules of civil procedure, Judge Julius N. Richardson of the US Court of Appeals for the Fourth Circuit ruled.
