Maryland Surgeon Defeats Untimely Medical Malpractice Claim

A patient lost her appeal in a suit against a Maryland surgeon who allegedly left a surgical clip in her because her claim filed 16 years later was untimely, a state appeals court said.

Linda Thomas alleged the surgical clip blocked the duct that transports urine from the kidney to the bladder, causing her injury. She complied with a state-law requirement to file a medical review commission complaint in 2016, then sued physician David Shear in 2017, though the surgery took place in 2000.
