A Louisiana Medicare Advantage plan sued the Biden administration over a knock in their quality rating stemming from the use of a calculation methodology the insurer alleges was unreasonable and arbitrary.
The complaint filed Thursday by Blue Cross Blue Shield of Louisiana subsidiary HMO Louisiana Inc. claims that the Centers for Medicare & Medicaid Services “directly contradicted the plain text of its own regulation” when it applied an “entirely different and new methodology that was not subject to any formal notice and comment rulemaking” to calculate the plan’s star rating.
