Long Island Surgeon’s Challenge to No Surprises Act Dismissed

HHS defeated a Long Island surgeon’s attempt to invalidate a new federal law that prohibits out-of-network medical providers from balance billing patients, when a federal court in New York said the provision doesn’t violate the doctor’s constitutional rights.

The No Surprises Act doesn’t violate the Seventh Amendment’s right to jury trial by requiring doctors to engage in an administrative arbitration proceeding against patients’ insurers to collect money allegedly owed for their services, the US District Court for the Eastern District of New York said.
