Local Opioid Settlements Endanger State Cases, Ohio AG Warns

Ohio’s top cop is raising an alarm bell that lawsuits targeting opioid makers, distributors, and pharmacies by local governments might be used as leverage to reduce claims brought by states.

Allergan PLC is pushing back against an Ohio lawsuit, arguing that the company’s settlement with local governments in metro Cleveland diminish claims the state can bring against the drugmaker, according to a Sept. 24 letter Ohio Attorney General Dave Yost (R) filed in the U.S. Court of Appeals for the Sixth Circuit.
