An Oklahoma woman’s next of kin can’t proceed with a federal court suit alleging her Arkansas health care providers failed to properly diagnose and treat her cervical cancer, a federal magistrate judge said.
A medical malpractice lawsuit filed by the administrator of De’Ja Curtis’ estate against Arkansas health care providers—who removed it to a federal court pursuant to its diversity jurisdiction,—is barred by Arkansas’ two-year statute of limitations, Magistrate Judge Jason A. Robertson of the US District Court for the Eastern District of Oklahoma, said Tuesday.
