Kentucky’s Last Outpatient Abortion Provider Fights State Limits

The last outpatient abortion provider in Kentucky is challenging a state law opponents say greatly limits women’s ability to have a second trimester abortion.

A federal trial kicking off Nov. 13 in the U.S. District Court for the Western District of Kentucky will test the constitutionality of Kentucky’s House Bill 454. It would impose criminal penalties on physicians who perform dilation and evacuation (D&E) abortion procedures without first stopping the heart of the fetus, but the court temporarily blocked enforcement of the law this year ahead of trial.
