Kentucky Woman Loses Suit Over Childbirth-Related Injury

A Kentucky woman can’t sue her doctors for injuries she sustained while giving birth because the doctors weren’t added to the suit until more than a year after her delivery occurred, the state’s top court said.

Kentucky’s one-year time limit for filing medical malpractice suits barred Jassaca Sneed’s claims against physicians Tanya Franklin and Jennifer Allen, the Kentucky Supreme Court said Thursday.

The court declined to extend the continuous treatment doctrine to toll the statute of limitations when a patient continued to receive care at the same hospital by different physicians.
