There is no implied contract between Kaiser Foundation Health Plan and the Queen’s Medical Center Inc. that would cover the amount the hospital can bill Kaiser members for emergency care, the District of Hawaii said.
Kaiser had a contract with QMC to pay for emergency care and other services provided to Kaiser’s members. The contract expired May 30, and the parties weren’t able to agree on a new one, the court said, dismissing the insurer’s complaint.
