Kaiser Faces Claims of Health Insurance Market Monopoly (1)

NorthBay Healthcare Group Inc.'s claims against Kaiser Foundation Health Plan for trying to monopolize the health insurance market in Solano County, Calif., have been reinstated, as the provider sufficiently alleged Kaiser’s conduct caused it an antitrust injury, the Ninth Circuit said.

NorthBay adequately alleged that Kaiser engaged in unlawful conduct that led it to suffer injuries the antitrust laws were designed to prevent, the U.S. Court of Appeals for the Ninth Circuit said.
