Juul Gets Mixed Win in Bid to Toss E-Cigarette Liability Suits

A Delaware trial court partially dismissed lawsuits against Juul Labs Inc. from over a thousand plaintiffs alleging product liability, fraud, negligence, and warranty claims over use of the company’s e-cigarettes.

Judge Kathleen M. Miller for the Superior Court of Delaware ruled the company’s motion to dismiss is met “with some success,” as some of the plaintiffs’ claims are barred by the economic loss doctrine, abrogation, or statute of limitations.

Other claims are not adequately pleaded, Miller said, but granted the plaintiffs’ request to amend their arguments.
