Judge Trims Pharmacy’s Suit Over Express Scripts’ Reimbursements

Express Scripts Inc. notched a partial win after a federal judge dismissed various claims from an independent pharmacy that alleged the company engaged in reimbursement practices that were in violation of Arkansas’ laws.

Lackie Drug Store Inc. “failed to plead a plausible claim” when it alleged the pharmacy benefit manager violated the Arkansas Unfair Practices Act when it treated other entities more favorably, Judge Maria A. Lanahan for the US District Court for the Eastern District of Missouri said in an order filed Tuesday that granted and denied in part Express Scripts’ motion to dismiss.
