Judge Gives Hawaii Chance to Update Drug Price Suit Against PBMs

Hawaii has another opportunity to seek damages against the country’s three largest pharmacy benefit managers over alleged unfair pricing practices after a federal judge partially dismissed the state’s latest complaint against the companies.

Judge Leslie E. Kobayashi of the US District Court for the District of Hawaii on Wednesday said the state failed to adequately satisfy the court’s standards for claiming violations of state laws prohibiting deceptive commercial acts and practices and unfair methods of competition in the government’s amended complaint against CVS Health’s Caremark, UnitedHealth Group’s OptumRx, and Cigna Group’s Express Scripts.
