Judge Drops Eli Lilly’s Suit Over Compounded Zepbound, Mounjaro

A federal court in Delaware ruled Wednesday that it didn’t have jurisdiction over Eli Lilly & Co.’s suit against Strive Compounding Pharmacy that alleged unlawful advertising of copycat versions of its tirzepatide, dismissing the case and suggesting the drugmaker sue in another state.

“Lilly is ‘clear’ that it does not challenge Strive’s drug sales, only its online statements,” Judge Stephanos Bibas for the US District Court for the District of Delaware said in an order. “But Lilly does not connect Strive’s internet marketing to Delaware.”

“So Lilly must sue Strive elsewhere,” he said.
