Judge Denies Shield for Copycats of Lilly’s Weight Loss Drug (1)

Drug compounders making copycat versions of Eli Lilly & Co.’s weight loss drug tirzepatide aren’t protected from FDA enforcement while a court decides whether the agency lawfully delisted the drug from the shortage list, a federal judge ruled.

The Outsourcing Facilities Association failed to demonstrate the likelihood of success on its claims that the Food and Drug Administration unlawfully removed tirzepatide from the drug shortage list, which would prohibit drug compounders from making copycat versions of the medicine, according to Judge Mark T. Pittman of the US District Court for the Northern District of Texas.
