Judge Allows Pharma Suit Over Illinois Pricing Law to Continue

The national group representing the generic drug and biosimilar industry may press on with its lawsuit against an Illinois anti-price gouging law after a federal judge on Thursday denied the state’s motion to dismiss the case.

The Association for Accessible Medicines has until Jan. 3 to file a motion for a preliminary injunction on the Illinois law, Judge Virginia M. Kendall of the US District Court for the Northern District of Illinois said in a status hearing on Illinois Attorney General Kwame Raoul’s (D) request to toss the industry group’s complaint.
