Iowa’s Covid Medical Immunity Law Bars Nursing Home Death Suit

A nursing home resident’s sons aren’t entitled to trial on claims that the facility’s failure to implement Covid-19 safety protocols resulted in their father’s death, a state appeals court said.

There was insufficient evidence that the nursing home engaged in reckless behavior or willful misconduct that would bring the case within an exception to an Iowa law that gives health-care providers immunity for actions arising during the pandemic, the Iowa Court of Appeals said Wednesday.
