An Iowa woman will get a second chance to prove a hospital negligently allowed her spinal surgeon to practice there, as a trial court improperly excluded an expert’s opinion about the facility’s standard of care, the state’s top court said.
An expert witness for Roxanne and Tony Rieder should have been allowed to testify that Mercy Medical Center breached the standard of care by failing to take action against David Segal based on a licensing board investigation and multiple malpractice lawsuits that had been filed against him, the Iowa Supreme Court said.
