Insulin Makers, PBMs Hit With Price-Fixing Lawsuit by Kentucky

The Commonwealth of Kentucky on Wednesday sued three leading drugmakers and multiple pharmacy benefit managers, claiming they worked in tandem to increase and fix prices for insulin.

Similar lawsuits have been filed by attorneys general from other states, including Arkansas, California, Illinois, Kansas, Louisiana, Montana, and Ohio.

Kentucky’s complaint alleges that for the past 15 years, Eli Lilly and Co., Sanofi-Aventis, and Novo Nordisk Inc. “have in lockstep raised the prices of their respective diabetes drugs in an astounding manner despite the fact that the cost to produce these drugs has decreased during that same time.”
