Indiana Supreme Court Rules for Governor in Pandemic Powers Suit

Indiana General Assembly leaders can’t call the part-time legislature back into a special session to overturn state health orders, the Indiana Supreme Court ruled Friday.

The five justices ruled for Gov. Eric Holcomb (R) and struck a law (H.B. 1123) that the GOP-controlled legislature enacted over Holcomb’s veto in 2021. While the legislature does have the power to change its session schedule, the state constitution would have to be changed to remove Holcomb’s sole authority to call in a special session, the justices said.
