An Indiana-led coalition of states is taking their argument that they should be allowed to help the federal Food and Drug Administration defend its in-person dispensing requirement for one of two drugs used in tandem to induce abortions to a federal appeals court.
Indiana, Louisiana, Alabama, Arkansas, Idaho, Kentucky, Mississippi, Missouri, Nebraska, and Oklahoma tried to intervene in a lawsuit brought by the American College of Obstetrics and Gynecologists to force the FDA to allow mifepristone to be mailed to patients, instead of requiring women to go to a hospital, clinic, or doctor’s office to pick up the medication.
