The Satanic Temple lacks the ability to sue to invalidate Indiana’s near-total abortion ban because it didn’t identify a member who’d been harmed by the law, the state told a federal appeals court.
The temple’s statistical “speculation” about how the Indiana law might affect a hypothetical member—one of about 6,000 female members who live in Indiana—wasn’t enough to give it associational standing to bring a constitutional religious rights claim on a member’s behalf, Attorney General Todd Rokita (R) saidMonday in a brief filed in the US Court of Appeals for the Seventh Circuit.
