Illinois doctors potentially can be held liable for allegedly negligent conduct that injured a baby in utero, leading the pregnant person to terminate her pregnancy, the state’s top court said.
A state law barring suits against doctors for the wrongful death of a fetus caused by abortion doesn’t prohibit suits against other doctors whose alleged medical malpractice during another procedure injures a nonviable fetus, even when the actual death is caused by an abortion, the Illinois Supreme Court said.
