Idaho Hospital Sues to Preserve Emergency Abortion Treatment

Idaho’s largest health-care organization has sued the state’s top lawyer to stop him from enforcing a law that likely would prevent its doctors from performing abortions in emergency situations.

The complaint filed in the US District Court for the District of Idaho on Tuesday against Attorney General Raúl Labrador (R) seeks to preserve the argument that the federal Emergency Medical Treatment and Labor Act preempts the state’s near-total ban on abortion when the procedure is medically necessary to treat a serious health emergency.
